Terms of Service and Rental Agreement

Welcome to Beachy Keen Vacations. By booking a property with us, you (the "Guest") agree to the following Terms of Service and Rental Agreement. Please read these terms carefully as they constitute a binding agreement between you and Beachy Keen Vacations.

1. Booking, Payment, and Identity

• Age Requirement: The primary guest reserving the property must be at least 25 years of age and must be present for the entire duration of the stay.
  

• Payment Terms: A deposit is required at the time of booking to secure your reservation. The remaining balance is due prior to your arrival as specified during the checkout process.
  

• Identity Verification: We reserve the right to request a copy of a valid government-issued ID and the credit card used for booking to prevent fraud and ensure guest safety.
  

2. Third-Party Software and Data Sharing

To provide a seamless booking and hospitality experience, Beachy Keen Vacations utilizes industry-leading third-party software. By agreeing to these terms, you consent to the sharing of your necessary information with our trusted partners:

• WanderOS (Booking & Property Management): Our direct booking website, reservation management, and payment processing are powered by WanderOS. Your personal details, booking information, and payment data are processed and stored by WanderOS to facilitate your stay.
  

• Breezeway (Field Services, Cleaning & Maintenance): We utilize Breezeway to manage our field service operations, including property cleaning, maintenance tasks, and property inspections. To ensure your rental is properly prepared and to allow us to address any maintenance requests during your stay, we share necessary reservation details (such as your name, contact information, and dates of stay) with the Breezeway platform.
  

3. Data Security and Technology Disclaimer

• Software Glitches and Outages: Beachy Keen Vacations relies on third-party platforms (including WanderOS and Breezeway) to manage reservations and property operations. We are not responsible for reservation errors, double bookings, or operational delays caused by unintended software glitches, system outages, or technical failures outside of our direct control.
  

• Data Security and Hacking: While we and our software partners implement industry-standard security measures to protect your personal and financial information, no digital system is entirely foolproof. By using our services, you acknowledge and agree that Beachy Keen Vacations shall not be held liable for any data breaches, hacking incidents, cyberattacks, or the subsequent loss or exposure of personal information, to the fullest extent permitted by law. You provide your data at your own risk.
  

4. Cancellations and Refunds

• Policy Adherence: Cancellations must strictly adhere to the specific cancellation policy selected and agreed to at the time of your booking.
  

• Refund Processing: Refunds, if applicable, will be processed solely based on the parameters of the agreed-upon cancellation policy. We highly recommend purchasing comprehensive travel insurance to protect your investment against unforeseen circumstances, illness, or travel disruptions.
  

5. Property Use and Occupancy

• Maximum Occupancy: The maximum number of guests is strictly limited to the capacity stated on the property listing. Over-occupancy violates local fire codes and will result in immediate eviction without a refund.
  

• Events and Gatherings: Parties, large gatherings, and events are strictly prohibited unless explicit written consent is provided by Beachy Keen Vacations management.
  

• Quiet Hours: Guests must respect local noise ordinances. Quiet hours are strictly enforced between 10:00 PM and 8:00 AM.
  

6. Property Rules

• Smoking: All Beachy Keen Vacations properties are 100% smoke-free. Smoking of any kind (including vaping and e-cigarettes) inside the property or on attached balconies will result in a minimum $500 deep-cleaning fee.
  

• Pets: Pets are only allowed in designated "Pet-Friendly" properties and require payment of a non-refundable pet fee. Bringing an unauthorized pet will result in additional fines and immediate eviction.
  

• Property Condition: Guests are expected to leave the property in a neat and orderly condition. While standard departure cleaning is included, excessive trash, extremely dirty dishes, or biohazards left behind will incur supplemental cleaning fees.
  

7. Damages, Maintenance, and Liability

• Reporting Issues: Guests must report any existing damage, cleanliness issues, or maintenance needs upon arrival. Any damage caused by the Guest or their party during the stay must be reported immediately so our field service team can address it via Breezeway.
  

• Financial Responsibility: The Guest assumes full financial responsibility for any physical damage, missing items, or excessive cleaning required due to the actions of the Guest or their invitees. We reserve the right to charge the payment method on file for such costs.

• Waiver of Liability: Beachy Keen Vacations and the property owner shall not be liable for any accidents, injuries, illnesses, or loss of personal belongings that occur while on the premises. Guests assume all risks associated with the use of the property and its amenities (including, but not limited to, pools, hot tubs, balconies, and beach access).
  

8. Check-In and Check-Out

• Check-in: Standard check-in time is 4:00 PM local time. Access codes will be provided prior to arrival.
  

• Check-out: Standard check-out time is 10:00 AM local time. Late check-outs must be approved in advance; unauthorized late check-outs will be subject to a fee, as they disrupt our Breezeway cleaning and inspection schedules.
  

9. General Provisions

• Force Majeure: Beachy Keen Vacations shall not be liable for any failure to perform its obligations under this agreement if such failure is caused by events beyond its reasonable control, including acts of God, severe weather, natural disasters, or government restrictions.
  

• Severability: If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  

• Governing Law: These terms shall be governed by and construed in accordance with the laws of the State of South Carolina. Any disputes arising from this agreement shall be resolved exclusively in the courts located in Horry County, South Carolina.
  

By completing your reservation, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service.
